O R D E R

% 20.09.2018 Learned counsel for the petitioner submits that the deceased died on 25th February, 2018. FIR was got registered by the complainant (brother-in-law of deceased) on 25th February, 2018. In the FIR complainant stated that the deceased was in habit of taking liquor. On 23rd February, 2018 he (deceased) returned home and at about 10:00 P.M. confided in complainant that one boy had stopped him at Chuna Bhatti Road and beat him up. Since no visible injury was there on the person of the deceased, he was not taken to hospital. However, at about 3:00 A.M., deceased told him that he was having pain in his abdomen. He was then taken to hospital where he died on 25th February, 2018.

As per the post mortem report deceased died on account of shock due to septicemia consequent to abdominal injury.

On 28th February, 2018, one Domilal approached the police and made statement that petitioner and co-accused Ranjit Mandal had stopped the deceased on 23rd February, 2018 at about 8:30 P.M. near Anandpur Satsang Bhawan, Vijay Vihar; co-accused Ranjit Mandal snatched cigarette of the deceased which resulted in a scuffle between them. Thereafter, petitioner caught hold of deceased while Ranjit Mandal gave beatings to him.

Petitioner is in custody for the last more than six months. Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `20,000/- (Rupees Twenty Thousand Only) with one surety in the like amount to the satisfaction of the trial court.
