% 26.07.2018 Mr. Puneet Mittal, learned Senior Counsel appearing on behalf of respondent No.5/The Delhi Public School Society, on instructions states that this Court does not have the territorial jurisdiction over the subject matter of the present petition, inasmuch as, the running of the subject school, which is the bone of contention between the parties, is at Chennai. Mr. Mittal, learned Senior Counsel further states that the petitioner should be relegated to the Court having territorial jurisdiction over the subject matter of the present petition, i.e. High Court of Judicature at Madras.

In view of the foregoing, Mr. V. Elanchezhiyan, learned counsel appearing on behalf of the petitioner seeks leave to withdraw this petition with liberty to institute an appropriate proceeding, in accordance with law, before the Court having territorial jurisdiction i.e. High Court of Judicature at Madras.

Leave and liberty granted.
