% 19.12.2017 I.A.No.15286/2017 The parties have entered into a Settlement Agreement before the Delhi High Court Mediation and Conciliation Centre, New Delhi on 17.10.2016. The terms and conditions of the Settlement Agreement are stated in para 6 of the Settlement Agreement. It was agreed in the Settlement Agreement that the defendants shall pay to the plaintiff a sum of Rs.26 lacs in full and final settlement of all the claims of the plaintiff and the payment was to make in the instalments. The parties have also filed the present application under Order 23 Rule 3 read with Section 151 CPC seeking to pass a consent decree in terms of the Memorandum of Understanding/Settlement Agreement dated 17.10.2016.
Sh.Rajendra Khare, Director of the respondent company is also present in person in court.
The parties shall remain bound by the terms and conditions of the
Agreement Settlement dated 17.10.2016. The suit is decreed in terms of the Settlement Agreement dated 17.10.2016. The terms and conditions as stated in para 6 of the Settlement Agreement shall form part of the said decree sheet. The suit stands disposed of.
In terms of the Section 16 of the Court Fees Act, the plaintiff shall also be entitled to refund of the court fees. JAYANT NATH, J.
