% 26.07.2017 I.A. 5601/2016 Since the application has already been disposed of, Registry is directed not to show the present application in the cause list. CS(COMM) 801/2016 Learned counsel for the defendant states that the defendant has no objection if the present suit is decreed in accordance with the paragraph 42(i), (ii) and (iii) of the plaint. He states that the defendant shall also destroy all the goods that had been seized by the Local Commissioner and handed over to it on superdari in the presence of an authorised representative of the plaintiffs.

Keeping in view the aforesaid statement, learned counsel for the plaintiffs gives up the relief for rendition of accounts, delivery up and disclosure.

The statements made by both the counsel are accepted by this Court and the parties are held bound by the same.

Accordingly, present suit is decreed in accordance with the paragraph 42(i), (ii) and (iii) of the plaint. Registry is directed to prepare decree sheet. MANMOHAN, J JULY 26, 2017 rn
