O R D E R
% 25.07.2016 Present contempt petition has been filed alleging wilful disobedience of order dated 09th December, 2013 whereby respondent-State undertook to provide a Police Picket and a Head Constable outside the residence of petitioner for twenty-four hours.
Learned counsel for petitioner states that respondents have now removed the Police Picket as well as the Head Constable. Learned counsel for petitioner further states that soon after the removal of Police Picket and Head Constable, the petitioner and his family members have again started receiving threats and on 07th May, 2016, an attempt was made to set the petitioner's house on fire. On the other hand, learned counsel for respondents, who appears on advance notice, states that there was no attempt to burn the petitioner's
house. He, in fact, states that a motorcycle parked outside the petitioner's house caught fire and as a result, petitioner's house suffered damage. He also states that an FIR in this respect bearing FIR No. 181/2016 has been registered with Police Station Daryaganj and the same is under investigation. In rejoinder, learned counsel for the petitioner disputes the contentions advanced by learned counsel for respondents. Having heard learned counsel for parties, this Court is of the view that security is a dynamic concept, which changes from time to time and the order dated 9th December, 2013 cannot be read to mean that petitioner's house would be provided round the clock security forever. Consequently, no violation of the order dated 9th December, 2013 is made out. As the petition discloses fresh grounds to apply for security, petitioner is given liberty to file a fresh petition. However, it is made clear that this Court has not expressed any opinion on the merits of the case and all rights and contentions of parties are left open.
With the aforesaid observations and liberty, present contempt petition and application stand disposed of.
