BAIL APPLN. 1372/2016 This is the third application by the petitioner before this Court seeking anticipatory bail in case FIR No. 39/2014 under Sections 489B/489C read with Section 120B IPC.
Learned counsel for the petitioner submits that the change in circumstance, after the two bail applications were dismissed, is that the three co-accused have been granted regular bail and the other FIR registered against the petitioner, which was mentioned by the learned APP while arguments in the first bail application was going on, is a false FIR. BAIL APPLN. 1372/2016
The three co-accused have been granted regular bail and not anticipatory bail. Moreover, the other FIR, that is, FIR No.46/2013 under Sections 489B/489C/120B IPC registered at PS Crime Branch existed when the first anticipatory bail application came up before this Court. The falsity or the truthfulness of the said FIR cannot be looked into in the present bail application.
Petition is dismissed.
