% 16.07.2018 Crl. M.A. 12697/2018 (exemption) Allowed, subject to all just exceptions. Application is disposed of. Bail Appln. 1631/2018 & Crl. M.A.12696/2018 (stay) Vide order dated 23.06.2018, learned Additional Sessions Judge-04, New Delhi District, Patiala House Courts, New Delhi granted custody bail to petitioner for three weeks to visit his home town at Bangalore and to take his wife to Kochi subject to certain terms and conditions as stipulated in the said order. DCP 3rd Batalian was directed to constitute the police security to take the petitioner from Delhi to Bangalore and thereafter to Kochi. Custody bail was granted to petitioner to facilitate him to be with his wife and to take care
of her treatment.
Presently the petitioner is in Kochi where his wife is receiving medical treatment.
It is submitted that the petitioner's wife has been advised to get FDG PET CT/MR on 16.07.2018 and compulsorily get admitted at Renai on 16.07.2018 (Monday) after PET scan for Pre Anesthetic check and surgery fixed for 18.07.2018. Medical certificate has been annexed. The petitioner approached the trial court for extension of custody bail by another 10 days which is disposed of vide order dated 13.07.2018. Earlier, wife of the petitioner was to be operated on 16.07.2018. However, as per the latest medical certificate, she has to be operated on 18.07.2018. Keeping in view the above facts, interim custody bail of the petitioner is extended till 24.07.2018, on the same terms and conditions. Learned senior counsel, on instructions, submits that another sum of `3 lacs would be deposited with DCP 3rd Battalion within three days. Bail application is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
