After the appeal was argued at some length for about an hour or so, counsel for the appellant on instruction from the appellant, who is present in person, states that appellant is agreeable to receive a sum of Rs.7,50,000/- in full and final satisfaction of his claims with respect to the subject Will of his father and on receipt of this amount the appeal as also the objections filed by the appellant would be withdrawn and judgment of the trial court dated 20.9.2008 be upheld. FAO 411/2008

It is agreed that the amount of Rs.7,50,000/- will be paid to the appellant by the respondent nos. 2 and 3 jointly or separately within a period of four weeks from today.

Amount be paid to the appellant by means of a banking instrument drawn in the name of the appellant and which banking instrument will be delivered either directly to the appellant or to the counsels for the appellant who appear in this Court today. Appellant is also under liberty to mention the details of his bank account to the respondent nos. 2 and 3 or their counsels within one week from today so that payment of Rs.7,50,000/- can be directly credited to the account of the appellant, namely, Sh. Desh Deepak Gulhati. 4.

The appeal is disposed of accordingly.
