% 19.01.2016 C.M. No.1974/2016 The petitioner on 30.01.2015 had agreed to vacate the suit property on or before 30.01.2016; one year time has been granted to the petitioner to vacate the property.

This is an application seeking extension of time which is largely based on the premise that the parents of the petitioner had died in this intervening period and he needs sometime to vacate the suit property. The prayer made in the application has been opposed by the respondent. Learned counsel for the respondent under instructions from his client states that the adjoining shop has been purchased by the petitioner and this is a commercial venture and if at all the petitioner wants to retain the premise, he should pay the market rent which according to him is between Rs.30,000/- to Rs.40,000/- per month. The

proposal has been put to the petitioner that he should pay the market ret to which he is not agreeable.

In this view of the matter, the present application is without any merit. Dismissed.
