The two plaintiffs namely Shri Monteg Singh Bedi and Ms. Hinshu Kaur as indigent persons have filed this suit for partition of property no.1/7163, Street No.3, Shivaji Park, Shahadra, Delhi and properties no. B26, B-27, S-66 to S-70, Vashisth Park, Pankha Road, Janakpuri, New Delhi. 2.
The case made out by the plaintiffs is, of the said properties belonging to a Hindu Undivided Family (HUF).

The properties are admittedly in the name of the grandmother of the plaintiffs. On a reading of the pleadings, no case of any HUF or of the plaintiffs having any share in the properties is made out. 4.
The father of the plaintiffs is still alive and has not been impleaded as a party.

The suit appears to have been filed in abuse of the process of the Court to wriggle out of the sales effected by the grandmother of the I.P.A. No.11/2016
plaintiffs Smt. Kanwaldeep Kaur impleaded as defendant no.2 of the said properties.

Faced therewith, the counsel for the plaintiffs unconditionally withdraws the suit.

Owing to such withdrawal I am refraining from imposing costs. 8.
Dismissed as withdrawn.
