% 10.11.2017 File of Crl.M.C.1426/2017 was directed to be sent to this Court by an order dated 22.09.2017. Today the file of Crl.M.C.1426/2017 has been sent to this Court.
This is a petition filed under Section 482 of the Criminal Procedure Code by the petitioners seeking quashing of FIR No.238/2014, registered at Police Station Subzi Mandi, Delhi dated 23.05.2014 under Sections 147/149/323/341/354A/ 506/186/353/34 IPC.
Counsel for the petitioners submits that the petitioners have expressed their remorse and tendered unqualified apology in CONT.CAS (CRL).No.7/2014, which has been accepted by the Court and the complainant/respondent no.2 (petitioners in the CONT.CAS (CRL).No.7/2014). The respondent no.2 is present in Court. She submits that in view of the unconditional apology so tendered by the petitioners, she would have no objection if the FIR in question is quashed.
In this case FIR No.238/2014, under Sections 147/149/323/341/354A/ 506/186/353/34 IPC was registered at the instance of respondent no.2 before
Police Station Subzi Mandi, Delhi on 23.05.2014. Statements of the petitioners and respondent/complainant have been recorded in CONT.CAS (CRL).No.7/2014 separately. In their statements, the petitioners have expressed their unqualified apology to the Court and the respondent no.2 herein. Statement of the respondent no.2 has also been recorded, wherein she has stated that with a view to put the matter at rest, she accepts the unqualified apology tendered by the petitioners herein.
In view of the fact that the parties have entered into an amicable settlement and the petitioners have tendered their unqualified apology, which has been accepted, the FIR No.238/2014, under Sections 147/149/323/341/354A/ 506/186/353/34 IPC registered at Police Station Subzi Mandi, Delhi and the proceedings arising therefrom are hereby quashed. The petition stands disposed of.
The date 11.12.2017 stands cancelled.
