% 25.03.2019 The challenge in this petition is to the order dated June 11, 2018 and electricity assessment order whereby the respondent has assessed the charges at Rs.2,12,064/-.
Learned counsel for the respondent BSES submits that against the aforesaid orders, petitioner has a remedy of appeal before the ADM concerned, under Section 153 of the Electricity Act, 2003. She states the only difficulty is that the appeal is maintainable only on the petitioner depositing 50% of the amount demanded vide the assessment order under challenge, before the said authority.
Subject to the deposit of Rs.1,00,000/- by the petitioner with the respondent organisation within two weeks from today, the petitioner shall be at liberty to approach the ADM. Till such time, the petitioner approaches
the ADM and the ADM decides the appeal to be filed by the petitioner, the electricity connection shall not the disconnected. The petition stands disposed of.
