% 15.02.2016 Impugned judgment is dated 31.10.2011. The RCT had set aside the order passed by the ARC dated 23.12.2010. This was an eviction proceeding filed by the landlord/respondent under Section 14(1)(a) of the DRCA.

After some arguments, it has been agreed that the impugned order be set aside. Accordingly, order dated 31.10.2011 is set aside. Parties to appear before the ARC on the date already fixed who shall proceed with the matter on merits.

During the pendency of the proceedings, third party interest shall not be created by the petitioner/alleged tenant. Petition disposed of in the above terms.
