% 26.11.2018 The deceased is the neighbour of the petitioners. Learned counsel for the petitioners submits that the petitioners were not aware about the heart ailment of the deceased. Only verbal altercation took place between the petitioners and deceased. Deceased was not beaten by the petitioner. As per the MLC no fresh external injury was noticed on the person of deceased. The deceased was brought to hospital by his son Sachin (complainant). Sachin did not tell the Doctor on duty that deceased was beaten by the petitioners.

He simply stated that a quarrel had taken place.

As per the post mortem, the death was caused due to "shock associated with coronary artery disease and its sequale".

Learned APP, who is assisted by the learned counsel for complainant, submits that the petitioners were well aware about the heart ailment of the deceased despite this they beat up the deceased resulting in his death. I have perused the FIR, post mortem report as well as MLC. Keeping in mind the totality of the facts and circumstances of this case, it is ordered that in case of arrest petitioners be released on bail, subject to each of them furnishing a personal bond in the sum of `20,000/- (Rupees Twenty Thousand Only) with one surety each in the like amount to the satisfaction of Arresting Officer/Investigating Officer/SHO of the concerned police station.

Bail application is disposed of in the above terms. However, petitioners shall appear before the Investigating Officer as and when required.
