O R D E R

% 21.07.2016 After some hearing, learned counsel for the parties agreed that effective from August, 2016, the respondent husband would pay an amount of `25,000/- to the petitioners towards her maintenance as well as that of the children. This would cover the school fee and all other expenses. It is also agreed that a sum of `1,50,000/- would be paid to the appellant as final settlement for the entire arrears of maintenance, if worked out on the basis of the modified amount of `25,000/-. The said amount of `1,50,000/- would be paid to the appellant in six equal monthly instalments and the entire amount paid on or before 31.03.2017.

In view of the above, the respondent is hereby directed to

ensure that the amount of `25,000/- is paid to the appellant on or before the 7th of every month or into her account. Learned counsel submits that the appeal does not survive consideration on merits in the light of the above agreed order. It is further agreed by the parties that the respondent is free to have visitation rights for two children who are presently in the custody of the appellant initially for two hours on weekend - this is subject to variation or further orders of the Family Court. Learned counsel urged that the Family Court be requested to expedite the proceedings. Having regard to the workload and the chronological pendency of the Family Court, the said Court is requested to expeditiously dispose of the pending petition.
