BAIL APPLN. 1639/2018 By this petition, the petitioner seeks anticipatory bail in case FIR NO. 445/2018 under Sections 307/34 IPC registered at PS Mangolpuri. The above noted FIR was registered on the complaint of one Bheem who stated that he was a student of B.A. 1st year. On 19th May, 2018 at about 3.30 PM he left his home to take campa when his neighbour Dinesh Mohan's sons who lived near the house, namely Naveen and Arun caught hold of him, stated that the complainant was behaving like the don of the area and started beating him. Meanwhile their relative Gaurav and Vishal BAIL APPLN. 1639/2018
also came there and started beating him. When he shouted loudly, on hearing his shouts his brother Arjun came and the moment Arjun tried to save him all the four accused left the complainant and stated that they should finish the brothers and after that started beating Arjun. In the meanwhile Arun took out a knife from his pocket and with the intention of hitting his brother started stabbing him. Naveen picked up a brick and hit the same on the head of his brother. When the complainant further shouted all the four boys ran away. As blood was oozing from his brother with the help of his neighbour Rahul, he took his brother on the motorcycle to the hospital. As per the contents of the FIR the petitioner is one of the perpetrator who started the incident and was not only beating the complainant and his brother but also hit him with a brick on the head which is also evident from the MLC which shows contused lacerated wound on the scalp. Considering the nature of injuries to Arjun this Court finds no ground to grant anticipatory bail to the petitioner. Petition is dismissed.
