Crl. M.C. 1198/2017 & Crl.M.A. 6762/2017 This is a petition under Section 482 Cr.P.C. moved by the petitioners for quashing of FIR No.791/2016, under Section 354/34 IPC, registered at P.S. Uttam Nagar, New Delhi.
Status report stands filed.
It is submitted by learned counsel for the petitioners that the petitioners and respondent No.2 are residents of nearby locality in Uttam Nagar, but due to some misunderstanding the respondent No.2 got registered the aforementioned FIR. He further submits that the petitioner No.1 has also lodged a cross FIR bearing No.792/2016, under Section 354/34 IPC, which has already been quashed. He also submits that after the registration of the
FIR, the near relatives and close friends intervened and the matter has been amicably settled between the parties and that nothing remains to be adjudicated upon further. He further submits that the present FIR is coming as a hurdle in the future life of the petitioners and prays that the present FIR may be quashed.
The respondent No.2/complainant is present in person and has been identified by the Investigating Officer, SI Rajpal and admits that she has amicably resolved all disputes with the petitioners voluntarily without there being any threat, coercion or pressure of any sort. She further submits that the counter FIR has already been quashed and that she has no objection, if the present FIR is quashed.
Keeping in view the facts and circumstances, since the matter has been amicably settled between the parties and nothing is to be adjudicated further, I deem it appropriate to quash the FIR in question. Consequently, to meet the ends of justice, the FIR No.791/2016, under Section 354/34 IPC, registered at P.S. Uttam Nagar, New Delhi and all the subsequent proceedings arising therefrom are hereby quashed. The petition and the accompanying application are disposed of accordingly.
