Notice is accepted by the learned counsel appearing for the respondent.

Learned counsel for the petitioner submits that the petitioner had made an application for upgradation of the school from Class VIII to Class XII. It is contended that the application was filed as far back as on 17.10.2015 and till date the application has not been disposed of.

He submits that the application, in fact, has been deferred because of certain actions which the respondent is proposing to take.

Learned counsel for the respondent submits that the application has been deferred in view of the breaches by the petitioner on which WP(C) 5968/2016

serious action is contemplated to be taken by the respondent. Learned counsel for the petitioner prays for the present petition to be disposed of with a direction to the respondent to dispose of the application dated 17.10.2015 in terms of sub Section 2 of Section 4 of the Delhi School Education Act, 1973, which stipulates that every application for recognition shall be entertained and considered by the appropriate authority and decision thereon shall be communicated to the applicant within a period of four months from the date of receipt of the application and where recognition is not granted, the reasons for not granting such recognition shall also be communicated within the said period.

In view of sub-Section 2 of Section 4, the respondents are directed to decide the application of the petitioner dated 17.10.2015 within a period of four weeks from today.

In view of the above, the petition is, accordingly, disposed of in the above terms.
