% 11.11.2016 CM No. 35647/2016 (for modification) The controversy is sought to be made out - wholly unnecessary, for this Court to dwell upon, with respect to the summons/notice. The applicant contends that summons was not served to counsel for the petitioner/assessee and the order of 29.08.2016 was wrongly recorded. Counsel for the respondents submits that despite service of summons, the applicant/petitioner has not cooperated.

There is no need for this Court to get into the controversy as to whether the summons were served or not and modify the order dated 29.08.2016 accordingly. It is open to the parties to place their contentions in the course of the proceedings that may follow.

Hence, the application is dismissed.
