% 07.08.2025 CRL.L.P. 475/2018 1.

The prosecution challenges the judgment dated 30.01.2018 passed by the learned Metropolitan Magistrate, acquitting the respondent for offences under Sections 279/304A of the Indian Penal Code, 1860 and Sections 3/181 of the Motor Vehicles Act, 1988.

It is alleged that on 16.05.2004, when the respondent was driving RTV vehicle bearing No. DL-1-VA-3823 in rash and negligent manner, caused the death of the victim, namely, Shakuntala Nagpal.

The learned Additional Public Prosecutor for the State submits that the respondent, admittedly, did not have any valid driving license.

when the driver is not authorized to drive, the act of driving is itself rash and negligent.
