At the time of filing this appeal bearing RSA 323/2016, application being CM No.40063/2017 was filed under Section 148 CPC seeking extension of time for payment of Court fee, on which following order was passed:

"C.M. Appl. No.40063/2016 (under Section 148 CPC seeking enlargement of time for filing Court fees) 3.

This application is allowed and deficient Court fees be made good positively within a week from today. 4.

The application stands disposed of."

In the instant case, despite the fact that only one week time was granted to pay the requisite Court fee, though two and a half months have expired, neither any application seeking extension of time to pay Court fee has been filed nor Court fee has been paid till date. 3.

This appeal, without there been requisite Court fee paid, cannot be treated as proper appeal, hence the same is hereby rejected. PRATIBHA RANI, J.
