% 19.09.2018 Notice. Learned APP accepts notice for respondent no. 1. Respondent no.2-Mrs. Shalini Jagiya @ Shalini Chopra is present in Court along with her counsel, who accepts notice. She has been identified by SI Kulvir Singh of police station K.N. Katju Marg.

Respondent no.2 submits that she has settled the matter with petitioner of her own free will and without any undue force, pressure or coercion vide Compromise Deed dated 08.12.2017. Her marriage with petitioner has already been dissolved by a decree of divorce by mutual consent dated 16.01.2018 passed by Family Court, North West District, Rohini Court, New Delhi. Petitioner undertakes to withdraw the application filed by him for cancellation of bail pending before the District & Sessions

Judge, Rohini Court within one week. Petitioner has no objection in case `1.50 lacs, lying deposited with the Family Court, North West District, Rohini Court, New Delhi, is released to the respondent no.2. Petitioner shall be bound by his statement. Respondent no.2 submits that she has no objection in case FIR No. 181/2011 under Sections 498A/406/506/34 IPC registered at police station K.N. Katju Marg and the consequent proceedings emanating therefrom are quashed, subject to release of `1.50 lacs by the Family Court.

Keeping in mind the settlement arrived at between the petitioner and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Family Court, North West District, Rohini Court, New Delhi is directed to release the demand draft of `1.50 lacs, together with interest accrued thereon, if any, to the respondent no.2 forthwith. Petition is disposed of in the above terms.
