% 20.09.2017 Present petition has been filed against the dismissal of the application filed by the petitioner for dropping of the proceedings on the ground that sanction order under Section 19 was invalid.

Learned senior counsel for the petitioner submits that the issue regarding 'validity of sanction; would be canvassed in detail at the time of final hearing and this question be kept open. With this liberty he seeks leave to withdraw this petition. It is clarified that the impugned order will not come in the way in considering the issue of validity of sanction a fresh at the time of final disposal of the case. Application for dropping of the proceedings is disposed of with liberty to the petitioner to challenge the sanction at the time of final arguments.
