Impugned order dated July 06, 2016 has adequately protected the petitioner inasmuch as permitting the sale of the secured asset the learned Debt Recovery Tribunal has directed that the bid would not be confirmed till further order is passed by DRAT.

Under the circumstances we are of the opinion, since the petitioner W.P.(C) 6006/2016

has been adequately protected and substantive issues urged in the writ petition have yet to be decided by DRT, at this stage it would be improper for this Court to prima facie reflect upon the merits of the controversy raised in SA-71/2016 by the petitioner.

Writ petition is accordingly dismissed.

No costs.

CM No.24748/2016 (for stay) The instant application is dismissed as the writ petition has been dismissed and the prayer made in the application is for grant of interim relief pending disposal of the writ petition.
