% 14.09.2016 This matter is taken up today as 13.09.2016 was declared a holiday on account of Eid.
The matter has been settled in court today. Undertakings have been recorded in court of Sh.Chunni Lai and Sh.Harish Lai, petitioners No.l and 4 respectively to vacate the tenanted premises on or before two years from today i.e. 14.09.2018.The petitioners have also undertaken to pay rent @ Rs.5,000/- per month as damages/user charges w.e.f September 2016 till the date they occupy the property plus electricity and water dues. Other undertakings also have also been given. The undertakings given by petitioners No.l and 4 are accepted and they shall remain bound by the same.
Petitioners No.2 and 3 are not present in court. Learned Senior By:AMULYA
u counsel appearing for the petitioners submits that their affidavits giving undertaking to vacate the said property in accordance with the statements made by petitioners No.l and 4 shall be filed in this court within two weeks from today.
Learned counsel appearing for the respondents submits that in view of the undertakings given by the petitioners, they will not execute the eviction order for the period of two years, namely, till 14.09.2018. However, in case of default in payment of the damages, the respondents shall be entitled to execute eviction order.
