Present petition has been filed by the petitioner under Article 226 of the Constitution of India read with Section 482 Cr.P.C. for modification of the order dated 15.02.2016 for release on execution of personal bond. Status report not filed.

I have heard the learned counsel for the parties and have examined the file. By an order dated 15.02.2016, the petitioner was granted three weeks furlough on his furnishing personal bond in the sum of `10,000/- with one surety in the like amount with other conditions. The petitioner could not furnish the required surety W.P.(CRL) 2102/2016

bond and had sought modification of the said order which was declined vide order dated 21.03.2016.

Nominal roll dated 20.06.2016 reveals that the petitioner was convicted for committing offences under Sections 376/302 IPC and was sentenced to undergo Rigorous Imprisonment for life with fine `10,000/-.

Crl.A.No.577/09 has been dismissed by this Court on 22.08.2012.

Considering the gravity of the offence and the life imprisonment awarded to the petitioner, he cannot be ordered to be released on execution of personal bond to avail furlough. The surety bond/amount to be furnished by the petitioner is quite reasonable. 5.

The writ petition is dismissed.
