% 09.03.2018 There are three cases pending between the parties arising out of the matrimonial dispute, one a petition for divorce presently registered as HMA case no.28/2017 which was filed in district Keonjhar, Odisha which is now pending in the court of the Principal Judge, Family Court of South-West District at Dwarka Court Complex; the other two including guardianship petition no.26/2015 and maintenance petition registered as maintenance case no.141/2015 former filed by the respondent and the latter filed by the petitioner against each other which are pending before the court of Mr. Dinesh Bhat, Judge, Family Court for West District at Tis Hazari Courts Complex. The petitioner is the ordinary resident of Janak Puri area in New Delhi which falls within the territorial jurisdiction of South-West District while the respondent is the ordinary resident of District Keonjhar in Odisha.

In these circumstances, the respondent having given no objection through counsel who is present, the prayer in the transfer petition is allowed. The guardianship case and the maintenance case are withdrawn from the Family Court for West-District at Tis Hazari Courts Complex and transferred to the court of the Principal Judge, Family Court for South-West District at Dwarka for further proceedings in accordance with law. The transferor court shall send the files of the two cases, complete in all respects, fixing an appropriate date for the parties to appear before the transferee court.

The transfer petition and the applications filed therewith stand disposed of in above terms.
