O R D E R

% 15.07.2016 Crl. M. A. 10500/2016 Exemption allowed subject to just exceptions. Crl. M.C. 2450/2016 The only grievance of the petitioner against the impugned order is that early hearing of the petitioner in his complaint/application under Section 156(3) of Code of Criminal Procedure, 1973 was dismissed. The petitioner's complaint came up for hearing before the learned Metropolitan Magistrate on 01st June, 2016. Since neither the complainant nor his counsel was present, the case was adjourned to 19th December, 2016. The petitioner moved an application for early hearing on the ground that the matter was taken up at 12:30 PM instead of 02:00 PM and, thus, he could not be present. The learned trial court noted that no time for taking up the

matter was fixed and it was taken when it reached. Considering the pendency of work before the learned trial court, it was not possible to prepone the date.

I find no reason to disagree with the order of the learned trial court. The petition is dismissed.
