O R D E R

% 08.03.2017 Crl.M.A.No.4052/2017 (for modification of order dated 16.02.2017) By way of this application, the applicant/respondent seeks modification of order dated 16.02.2017 whereby the surety amount of Rs.25,000/- was directed to be released to applicant/respondent by way of pay order/traveller cheque.

It is submitted by ld. counsel for applicant/respondent that pursuant to order dated 16.02.2017, Registry has prepared the pay order in favour of the respondent, however, it is not feasible for respondent to get the said pay order realised as the applicant/respondent being a foreign national having no bank account in India.

Appellant present in person and submits that the surety amount of Rs.25,000/- which was ordered to be released in his favour by way of pay order be now released in the name of his counsel, namely, Mr. Sikanader Azam Khan as he reports no objection for the amount being released in favour of his counsel. Statement of applicant/respondent to this effect is recorded separately.

Heard.

In view of averments made in the application as also to the statement of respondent having been recorded, the order dated 16.02.2017 is modified directing the registry to release the surety amount of Rs. 25,000/- alongwith interest accrued thereon, if any, in favour of Mr. Sikandar Azam Khan, counsel for respondent by way of pay order.

The application is disposed of.
