Mr Ramesh Singh, learned counsel appearing for the respondent submits that subsequent to the filing of the present petition, the respondents have passed a fresh order dated 28.05.2018 after affording the petitioner an opportunity to be heard. He states that in the aforesaid view, the order impugned in the present petition no longer survives. 2.

The learned counsel for the petitioner has filed an application seeking leave to amend the present petition in view of the order dated 28.05.2018. It is seen that the petitioner has not filed an amended petition along with his application.

Since the order impugned in this petition does not survive, this Court considers it apposite to dispose of the petition leaving it open for the

petitioner to file a fresh petition. Accordingly, the petition is disposed of with liberty to the petitioner to file afresh. 4.

The pending application stands disposed of.
