% 21.02.2017 Crl.M.A. 11609/2014 (revival of FIR) Crl.M.C. 3753/2012 was disposed of by this Court on 4th March, 2013 quashing the FIR 117/2012 under Sections 406/420/467/468/471/120B IPC registered at PS Economic Offences Wing, Mandir Marg, Delhi on the ground that parties had settled the matter. The order sheet was duly signed by the parties identified by their respective counsels. The present application has been filed by respondent No.2 seeking revival of the FIR. However after filing the present application, the respondent No.2/applicant is taking repeated adjournments. Adjournment was sought by learned counsel for the applicant on 26th April, 2016 then again on 3rd November, 2016. Thus this Court while adjourning the application for today on 3rd November, 2016 imposed costs of ₹5000/- to be deposited by respondent No.2 with the Delhi High Court Legal Services Committee within three weeks. No proof of deposit of costs has been filed.

Despite pass over, none is present on behalf of the applicant/respondent No.2.

Application is dismissed for non-prosecution. MUKTA GUPTA, J.
