The Court on 21.01.2025 directed for issuance of Court notice to the plaintiff and his counsel.

The Office Report indicates that the counsel was served despite that there is no appearance.

Once the summons of the civil suit was served and the plaintiff was contesting the civil suit earlier, it is not necessary to await the service of the Court notice. The Court is left with no option except to dismiss the instant suit.

Accordingly, the instant suit stands dismissed under Order IX Rule 8 of the Code of Civil Procedure, 1908.
