The present application has been filed by the appellants stating inter alia that the dispute between the parties has been amicably settled before the Mediation Centre, Tis Hazari Courts. A copy of the Settlement Agreement dated 02.12.2016 has been enclosed with the present application. 2.
Counsel for the appellants states that in terms of the settlement, the appellants have already received a sum of Rs.30,000/- out of the settled amount of Rs.40,000/- and the balance amount shall be paid by the respondent in accordance with the terms and conditions of the Settlement Agreement. He states that in view of the settlement arrived at between the parties, the appellants may be permitted to withdraw the present appeal. RFA 602/2013

In view of the averments made in the application, the appeal is disposed of as withdrawn in terms of the settlement arrived at between the parties.

At this stage, counsel for the appellants states that as the parties have arrived at a settlement through the process of court annexed mediation at the stage of admission in the appeal, the appellants may be issued a certificate for refund of the court fees affixed on the appeal. 5.
In view of the aforesaid submission, the Registry is directed to issue a certificate of refund of the court fees to the appellants under Section 16 of the Court Fees Act.

Trial court record be returned.

File be consigned to the record room.
