% 21.04.2016 It is observed that a CCP in the suit has to be decided not by this court as the contempt is said to be an order of this Court but by the transferee court in view of the judgment of a learned Single Judge of this court in Gobind Sarda Vs. Sartaj Hotels Apartments, 130 (2006) DLT 460. Accordingly, this contempt petition is sent back for being marked to the appropriate transferee court by the Distt. & Sessions Judge, (South-East) Saket Courts, New Delhi, on 29th April, 2016 when the main suit bearing CS(OS) 2945/2011 is already listed for being marked to the competent court.
