This is a petition under Section 11 of Arbitration and Conciliation Act, 1996 („1996 Act‟) for appointment of an Arbitrator in the matter.

Counsel for the respondent submits that he has no objection to the prayer made in the petition.

Counsel for the petitioner has suggested the appointment of Hon‟ble Mr.Justice Kailash Gambhir, former Judge of this Court, as an Arbitrator.

4.

Mr.Snehal Kakrania, who, appears on behalf of the respondent submits that he has no objection if Hon‟ble Mr.Justice Kailash Gambhir, former Judge of this Court is appointed as an Arbitrator in the matter.

Accordingly, as agreed by counsel for both the parties, Hon‟ble Mr. Justice Kailash Gambhir is appointed as an Arbitrator. 6.

Counsels also agree that the arbitration proceedings shall be held under the aegis of Delhi International Arbitration Centre („DIAC‟).

7.

The Rules and the fee schedule as prescribed by DIAC shall govern the arbitration proceedings.

8.

Accordingly, the petition is disposed of.
