O R D E R

% 18.07.2018 The petitioner is a government servant. He seeks anticipatory bail as he is apprehending his arrest in connection with FIR No.42/2018, under sections 186/353/332/34 IPC registered at Police Station Old Delhi Railway Station, Delhi. He is accused of having assaulted a passenger and of taking monies out of his wallet when in discharge of his official duty the petitioner was checking the passenger tickets/ platform tickets of persons exiting from the railway platform. It is alleged that in the melee, the petitioner has also assaulted a policeman. A cross-complaint has been filed by the petitioner as well.

It is the petitioner's case that he has been falsely implicated in the FIR, that he was discharging his duties as a 'Travellers Ticket Examiner (TTE); he has clean antecedents and in his entire employment of 12 years he has never had any blemish in his records; that he is ready and willing to join the investigations.

Let the petitioner join the investigation and report before the Investigating Officer at Police Station Old Delhi Railway Station tomorrow i.e. on 19.07.2018 at 3. 00 p.m.

It is directed that in the event of arrest of the petitioner in FIR No.42/2018, under sections 186/353/332/34 IPC registered at Police Station Old Delhi Railway Station, Delhi, he be released on bail on his furnishing a personal bond in the sum of Rs.15,000/- with a surety in the like amount to the satisfaction of the Arresting/Investigating Officer, subject to the following conditions:

(i) the petitioner shall continue to participate in the investigations as and when he is so intimated by the Investigating Officer; (ii) his shall furnish his mobile phone number to the Investigating Officer, which shall be kept operational at all times, so that the police could contact him;

(iii) he shall not make any effort to evade the process of law; and (iv) in case of change of the phone numbers or address, the petitioner shall inform the police forthwith.

Any observations made in this order shall have no bearing on the merits of the case.

The petition is disposed-off in the above terms. A copy of this order be given dasti to the learned counsel appearing on behalf of the parties under the signature of the Court Master. NAJMI WAZIRI, J.
