The petitioners have filed the present petition, inter alia, praying that directions be issued to the respondents to restrain from constructing or installing wall or any gate on the pathway leading to the cremation ground, infant burial ground and agricultural land and thereby also stopping the tractor movement, movement of farm produce and other villager movement. It is also alleged that the respondents were destroying the water body on the land acquired by the respondents.

The respondents have also filed an affidavit, clearly indicating that the construction being raised by them is not blocking the road to the cremation ground and there is no water body, which is being destroyed. The learned counsel appearing for the petitioners states, on instructions, that in view of the affidavit filed by the respondents, the petitioners' grievance does not

survive. He requests that the petition may be disposed of. 3.

The petition is, accordingly, disposed of. The pending application also stands disposed of.
