% 15.07.2016 Issue notice. Learned APP accepts notice.

The petitioner seeks interim bail to attend the wedding of his only sister which is fixed on 20.07.2016. The order passed by the learned ASJ on 08.07.2016 shows that the factum of the marriage which is to be solemnized on 20.07.2016 has been got verified. The learned ASJ had proposed to grant custody parole to the applicant to attend the marriage, however, the same was refused.

The submission of learned counsel for the petitioner is that the petitioner has been behind bars since 09.08.2014. She submits that a custody parole would vitiate the atmosphere at the wedding since people from the community would be there and having outsiders would embarrass the

petitioner and his family. Learned counsel submits that the petitioner may be granted interim bail for a short period.

In these circumstances, considering the fact that the petitioner has been in JC since 09.08.2014 and apparently, the independent witnesses and the victim have been examined, the accused is granted interim bail for a period of one week. The same is subject to the condition that he shall furnish his personal bond with one surety in the sum of Rs. 10,000/- to the satisfaction of the Jail Superintendent. The applicant shall report to the SHO of the local police station on the fourth day of his release to mark his attendance. He shall duly surrender punctually at the end of period of interim bail. During the period of his release, he shall not, in any manner, try to get in touch with the complainant and any other witnesses.

The petitioner shall provide his mobile phone number at the time of his release which shall be kept in working condition at all the times and shall not be changed without prior intimation to the Jail Superintendent. A copy of this order be communicated to the Jail Superintendent. The bail application stands disposed of in the aforesaid terms. Dasti.
