Learned counsel for the petitioner states that the marriage with the respondent No.1 is a nullity.

The impugned order passed by the learned Trial Court is an interim arrangement. Payment of `1 lac is without prejudice to the rights of the parties. The petitioner will be at liberty to raise all these issues regarding validity of the marriage before the Trial Court. The payment so made by the petitioner shall be without prejudice and subject to outcome of the petition on merits. In case, the petitioner succeeds, the Trial Court will be at liberty to order return of this amount.

In view of the above, learned counsel for the petitioner seeks permission to withdraw the present petition. The petition is dismissed as withdrawn with the above observations.
