versus STATE OF NCT OF DELHI & ORS ..... Respondents Through:

Respondent no.2 in person.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 23.07.2018 Notice. Learned APP accepts notice for respondent no.1. Respondent no. 2 in present in Court and have been identified by SI Vikas Mudgal of police station Khyala.

It is submitted that petitioner and respondent no. 2 are neighbours. A quarrel took place between them on some trivial issue which led to registration of FIR No. 167/2013 under Section 435 IPC against the petitioner at police station Khyala, on the complaint of respondent no.2. Now, with the intervention of their common friends and other family members, petitioners and respondent no. 2 have settled their disputes amicably vide Compromise Deed dated 30th June, 2018, therefore, aforesaid

FIR may be quashed.

Respondent no. 2 submits that he has settled the matter with the petitioner of his own free will and without any undue force, pressure or coercion, therefore, he has no objection in case the FIR is quashed. Affidavit of respondent no. 2 in this regard is on record at pages 13-14.

Keeping in mind the settlement arrived at between the parties voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending.

Accordingly, aforesaid FIR and the consequent proceedings emanating thereform are quashed. Petition is disposed of in the above terms.

Miscellaneous application is disposed of as infructuous.

Dasti.
