% 25.10.2018 Learned counsel appearing for the plaintiff submits that there are certain defects in the plaint and he seeks permission to withdraw the suit with liberty to file a fresh suit on the same subject matter. Learned counsel appearing for the defendant after some submissions submits that without prejudice to his rights and contentions he would have no objection to the said request.

Keeping in view the submission of the plaintiff, he is permitted to withdraw the present suit with liberty as prayed for under Order XXIII Rule 1(3)CPC.

Suit is dismissed as withdrawn accordingly. All pending applications, if any, also stand disposed of accordingly.
