O R D E R
% 18.04.2017 This is an application under Section 439 Cr.P.C. filed on behalf of the petitioner for grant of interim bail for two months in case FIR No.292/2015, under Sections 307/302/34 IPC, Police Station Dabri, Delhi. Learned counsel for the petitioner submits that the son of the petitioner is going to be married on 7th May, 2017, however, the ceremonies of the marriage will start from 27th April, 2017 onwards. Counsel further submits that being father, the presence of the petitioner on the occasion of marriage of his son is very essential and sine qua non and prays that the petitioner may be released on interim bail to attend and participate in the marriage ceremony of his son.
Status report has been filed by the State and learned APP for the State submits that the factum of marriage of the petitioner's son has been verified to be correct. However, the marriage is to take place at Samastipur, Bihar, for which some safeguards measures may be taken. Looking into the above facts and circumstances, since the marriage of
the petitioner's son is to be solemnized on 7th May, 2017 and that the presence of the petitioner on the said marriage is essential, I admit the petitioner on interim bail from 1st May, 2017 to 10th May, 2017 to enable him to attend the marriage ceremony of his son at Samastipur, Bihar, on his furnishing bail bond in the sum of Rs.25,000/- with two local sureties of the like amounts to the satisfaction of the concerned Court with the direction that the petitioner shall report to the concerned local Police Station of his area and he shall not contact and influence the prosecution witnesses and shall also not tamper with the prosecution evidence in any manner. On the expiry of the interim bail period, the petitioner shall surrender before the concerned Jail Superintendent, who shall submit a report to his Court. With the above directions, the present bail application is disposed of. Copy of this order be sent to the concerned Jail Superintendent forthwith for information and necessary compliance. A copy of this order be given dasti to the counsel for the petitioner, as prayed.
