IN THE HIGH COURT OF DELHI AT NEW DELHI

+ BAIL APPLN. 1417/2016 NAIN SINGH ..... Petitioner Through:

Mr. Sugriva Dubey, Adv.

versus STATE OF DELHI ..... Respondent Through:

Ms. Kusum Dhalla, APP for State with SI Amit Kumar, P.S. Anand Vihar.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 19.07.2016 By this application under Section 438 Cr.P.C., petitioner seeks anticipatory bail. I have perused the allegations levelled in the FIR, which are serious in nature. Complainant has alleged that on 11th June, 2015 at about 06:30 pm petitioner along with his accomplices waylaid him and threatened him by saying that in case he did not pay `2 lacs to him within 10 days and his wife does withdraw her complaint they will face serious consequences; petitioner also showed a pistol to him and again threatened that in case `2 lacs were not given within 10 days, on eleventh day he will catch his sons and send them to Uttar Pradesh. Learned APP for the State submits that petitioner is successfully evading arrest despite rejection of his bail application by the trial court. It is

further submitted that petitioner had earlier filed an anticipatory bail application, which he withdrawn.

Keeping in mind the totality of circumstances, I am not inclined to extend the benefit of anticipatory bail to the petitioner. Bail application is dismissed.
