The Petitioner No.1 is stated to have expired. However, legal heirs of Petitioner No.1 are already on record as Petitioner Nos.2 to 5. 2.
The Respondent/landlord is present in person in Court today along with Petitioner Nos.2 and 3.

Learned Counsel for the parties submit that the parties have reached an amicable settlement outside of the Court. In pursuance of such settlement, a Memorandum of Understanding (MoU) was executed by the parties on 07.10.2024.

Learned Counsel for the parties, on instructions from the parties submit that all disputes between the parties have been settled. Learned Counsel for the Petitioners/tenants, on instructions, submits that the Petitioners/tenants have complied with their obligations under the MoU and that the possession of Shop No.1 admeasuring 39 X 10 ft. as well as the back open portion attached to Shop No.1 admeasuring 400 sq. ft. [hereinafter referred to as "Shop No.1] has been handed over to the Respondent/landlord.
5.1 The Respondent/landlord acknowledges the receipt of possession of Shop No.1.

Learned Counsel for the Respondent/landlord submits that in terms of the MoU, the cases that are pending before the Court and before the Executing Court shall be withdrawn by the Respondent/landlord. In addition, it is contended that a sale deed shall be executed by the Respondent/landlord in favour of the Petitioners/tenants for Shop No.2 admeasuring 39 X 10 ft., situated at Property No.51/1, Ground Floor, New Market, Karol Bagh, New Delhi, on the terms set out in the MoU. 7.
The parties undertake to this Court that they shall remain bound by the terms as set out in the Memorandum of Understanding dated 07.10.2024. 8.
Learned Counsel for the parties jointly submit that the present Petition can be disposed of in terms of the settlement arrived at between the parties.

The present Petition and all pending Applications are disposed of. 10.
