HON'BLE MR. JUSTICE P.S.TEJI

% 09.03.2016 The present petition has been filed by the State for quashing and setting aside the order dated 15.03.2014 passed by the learned Sessions Court in Crl.Revision Petition No.157/2013. During the course of arguments, it has been submitted that in the instant case there were seven accused persons, out of whom both the respondents had been discharged while one accused passed away during the trial and the trial stood abated against him. It has been submitted by the learned counsel for the respondents that during the pendency of the petition, vide order dated 07.01.2016,

the main trial stands concluded and the remaining four accused persons stand acquitted.

In view of the same, this court is of the considered opinion that when the accused persons against whom charge was framed stand acquitted on the basis of the evidence produced by the State, nothing survives in the present petition against the respondents, whose discharge is challenged by the State by way of the present petition. Consequently, no order is required to be passed in the present petition and the petition stands disposed of. P.S.TEJI, J MARCH 09, 2016/dm
