CORAM:

HON'BLE MS. JUSTICE MUKTA GUPTA

O R D E R

% 26.07.2018 By this petition the petitioner seeks quashing of FIR No.673/2015 under Sections 354A/354C/354D/506/34 IPC registered at PS Neb Sarai on the complaint of respondent No.2 and the proceedings pursuant thereto on the ground that the parties have settled the matter. On the last date of hearing learned counsel for the State had submitted that besides the petitioner one minor was also involved and thus Amended Memo of Parties was filed impleading the minor as petitioner No.2 through the guardian. However, today learned ASC for the State submits that the proceedings against the minor have already culminated and he has been released on admonition. Thus, the proceedings against the present petitioner only are surviving. Hence, Amended Memo of Parties be taken off the record.

W.P.(CRL) 2152/2018

Statement of respondent No.2 was recorded by this Court on the last date of hearing wherein she stated that she has settled the matter with the petitioner and does not wish to pursue the above noted FIR and the proceedings pursuant thereto. She stated that she was residing in Uttar Pradesh and she could not come to the Court again and signed the order sheet in acknowledgment of her statement made before this Court on the last date of hearing.

Considering the statement of respondent No.2 and the fact that the parties have entered into a settlement, no useful purpose would be served in continuance of the proceedings, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. Consequently, FIR No.673/2015 under Sections 354A/354C/354D/ 506/34 IPC registered at PS Neb Sarai and the proceedings pursuant thereto are hereby quashed.

Petition is disposed of. Order Dasti.
