Respondent No.2 has produced her election card as proof of her identity. The IO is also present who identifies her. Respondent No.2 has tendered an affidavit in support of the petition along with a copy of her election identity card. The same is taken on record. Learned counsel for the petitioner has delivered a pay order for Rs.5 Lakhs drawn on Canara Bank bearing No.174762 in favour of respondent No.2,
which has been accepted by her. Learned counsel for the petitioner points out that the petitioner is seeking quashing of the FIR in question on account of settlement reached in mediation vide settlement agreement dated 09.06.2016. Under the said agreement, an amount of Rs.13,01,000/- has to be returned to the complainant by the petitioner. In terms of the settlement, an amount of Rs.4 Lakhs was paid earlier and Rs.5 Lakhs has been paid today in Court. The remaining amount of Rs.4,01,000/- shall be paid when the complainant executes the sale deed or at the time of recording of settlement of the parties in the suit for cancellation of sale deed, as noted in the settlement agreement itself.
In view of the aforesaid, in my view, no useful purpose would be served in keeping the aforesaid FIR and case arising therefrom pending. The same are, accordingly, quashed.
