% 08.09.2016 The petitioner has preferred the present petition to seek parole to reestablish his social ties. The application of the petitioner to seek parole was rejected on 08.06.2016 by the respondent on the ground that he is convicted in a case of serious nature. He is a habitual criminal and is involved in another case FIR 239/2002 under Section 323/341/34 IPC at PS Narela. The status report filed by the State has been taken on record. Ms. Vohra submits that the address of the petitioner has been got verified. The petitioner is involved in another case, as aforesaid. However, the nominal roll shows that out of the sentence of three and half years rigorous imprisonment awarded under Section 307/34 IPC apart from fine, the

petitioner has already undergone over two years and three months incarceration apart from earning a remission of around seven months. The unexpired portion of the sentence as of now is about six months. The jail conduct of the petitioner is reported to be satisfactory. Even earlier, he was released on parole between 19.08.2015 and 20.09.2015 by this court. His conduct during the parole period has not been found to be objectionable. Accordingly, the petition is allowed and the petitioner is directed to be released on parole for a period of four weeks subject to his furnishing personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the Jail Superintendant.

In case the petitioner is in custody in any other case, he shall be released only after he obtains bail in such other case. The petitioner shall report at local police station to mark his attendance on every Monday at 11:00 a.m. during the period of parole, and he shall duly surrender at the end of the period of parole.
