BAIL APPLN. 1669/2018 The petitioner is facing sessions trial arising out of FIR No.484/2015 of Police Station Mundka involving offences punishable under Sections 302/394/397/120-B IPC and Sections 25 and 27 of the Arms Act, the case being based on circumstantial evidence including last seen evidence adduced through PW-1. Undoubtedly, the petitioner was arrested on 30.09.2015 and has been in custody ever since, he having been denied release on bail on several applications moved one after the other over the period. The petitioner seeks release on bail primarily on the ground that all the material witnesses have already been examined and that the case for the BAIL APPLN. 1669/2018

prosecution as far as he is concerned is on shaky grounds. These submissions have been considered by the Additional Sessions Judge presiding over the trial by his very detailed order dated 10.07.2018 whereby his application with similar prayer was dismissed. It would not be proper for this court at this stage of the trial to scrutinize in detail the merits or demerits of the evidence. Suffice it to note that the last seen evidence adduced through PW-1 is statedly supported by further evidence wherein the motorcycle used in the crime is stated to have been recovered upon disclosure at the instance of the petitioner. Having gone through the record, this court finds the reasons why release on bail has been denied by the court of sessions at the present stage of the process are sound and, therefore, do not call for any different view to be taken by this court.

The petition is dismissed.
