% 27.07.2018 I.A. No. 9813/2018 (under Order XXIII Rule 3) An application under Order XXIII Rule 3 has been moved by the parties. The Plaintiff had filed the present suit in respect of its product 'FAIR & LOVELY' and the packaging thereof. The Defendants have, since the filing of the suit, changed their packaging and mark to 'FAIR FAIRY' ss contained in Annexure A to the application. The terms of the settlement are contained in paragraph 3 of the application. The undertakings given by the parties are accepted. Parties shall be bound by the undertakings given therein. I.A. is allowed. The suit is decreed in terms of settlement which has been filed. The Plaintiff does not press the reliefs in paragraphs 61 (i), (iii), (iv), (vi) and (vii). The terms of settlement, along with the Annexure-A containing the new packaging, shall be made part of the decree. Decree sheet be drawn. Suit is disposed of as settled.
